Terms and Conditions

"We," "us," and "our" refer to Scope U Photography, operated by Durham Osborne. "You" and "your" refer to the person or entity purchasing a licence. "Image" refers to any photograph available for licensing through our website. "Licence" refers to the permission granted to use an Image according to specific terms.

All Images remain the copyright of Durham Osborne / Scope U Photography. Purchasing a Licence does not transfer ownership or copyright. We retain all rights not expressly granted in the Licence.

Upon purchase, we grant you a non-exclusive, non-transferable licence to use the Image according to your selected Licence type (Editorial Use, Personal Use, or Extended/Commercial Use where available). The Licence is granted in perpetuity unless otherwise specified.

You may NOT:

(a) Resell, redistribute, or sublicence the Image;

(b) Use the Image in any way that suggests endorsement by third parties appearing in or associated with the Image (including brands, sponsors, drivers, or teams);

(c) Use the Image for defamatory, obscene, or illegal purposes;

(d) Remove or alter any watermarks, copyright notices, or metadata;

(e) Use the Image beyond the scope of your purchased Licence.

Images may contain third-party intellectual property (including but not limited to brand logos, trademarks, and recognisable individuals). We do not warrant that model releases or brand permissions have been obtained. You acknowledge that certain uses may require additional permissions from third parties, and you are solely responsible for obtaining such permissions where required.

All uses of our Images require attribution to "Scope U Photography" or "Durham Osborne / Scope U Photography." Attribution should be placed in reasonable proximity to the Image where practical.

We provide Images "as is" without warranty. We shall not be liable for any claims arising from your use of Images, including claims by third parties regarding intellectual property, privacy, or publicity rights. Our maximum liability shall not exceed the Licence fee paid.

These terms are governed by the laws of New Zealand. Any disputes shall be subject to the exclusive jurisdiction of New Zealand courts.
